By submitting this Application and, if accepted, participating in this competition, I acknowledge that I have read, understood, and agree to abide by all competition guidelines, rules, and policies. I understand that not all Applications may be accepted for various reasons, which should not be regarded as a reflection on my culinary skill. I further agree to accept all decisions made by the judges and [organizing committee] as final and binding. I hereby grant Kelber Catering, Inc., the other sponsors of the competition, and their respective affiliates and assigns a royalty-free license to use and publish my name and likeness and the name and service marks of my business in the promotion and publication of this competition regardless of my level of success in the competition and to use those recipes during the year following the competition. I warrant that all of the recipes and techniques used in my submission are original and will not infringe upon the intellectual property rights of any third party. It is expressly understood and agreed that nothing herein contained, the competition guidelines, rules and policies, or otherwise shall be construed as creating any liability whatsoever, express or implied, for Kelber Catering, Inc., other sponsors, members of the Steering Committee, judges, and their respective affiliates, and their respective owners, officers, employees, agents, and representatives (the “Sponsor Parties”). Without limiting the generality of the foregoing, none of the Sponsor Parties shall have any personal liability to me or any person claiming through me. I hereby discharge and covenant not to sue any of the Sponsor Parties for any liabilities, damages, causes of action, or claims related to the competition. I hereby release and agree to defend, indemnify, and hold each of the Sponsor Parties harmless from any and all suits, demands, fines, claims, liabilities, damages, losses, or expenses arising out of, resulting from or in connection with my participation in this competition whether caused by their negligence or otherwise, except for any willful or intentional misconduct of a Sponsor Party, without right of subrogation or contribution. Notwithstanding the foregoing, the maximum liability of a Sponsor Party shall be limited to the cost of the ingredients used in making my submission to the competition.
